A Settlement Fund of $1,000,000 has been established to pay the Settlement Class, together with notice and administration expenses, approved attorneys’ fees and costs, and a service award to the Class Representative. Additionally, as part of the Settlement Agreement, Defendant has agreed to maintain the purchase flows for tickets to its Splish Splash waterpark on its website in a manner that either (1) does not charge fees on ticket sales, or (2) if fees will be charged, Defendant shall clearly and conspicuously disclose the total cost of the tickets, inclusive of fees, prior to the ticket being selected for purchase, unless and until New York Arts and Cultural Affairs Law § 25.07(4) is amended, repealed, or otherwise invalidated.


Your Legal Rights and Options in This Settlement

Submit a Claim Form

To receive a pro rata share of the Settlement Fund, which will be based on the total amount of fees you paid, you must submit a timely and complete Claim Form no later than August 10, 2026. You can file a claim online. Your claim must be submitted by 11:59 p.m. EST on August 10, 2026.

Object

Tell the Court why you do not like the proposed Settlement. If the Settlement is approved, you will still be bound by the Settlement, and you may still receive a cash payment. Objections must be received no later than May 26, 2026.

Exclude Yourself

To exclude yourself from the Class, you must send a letter by first-class mail stating that you request to be excluded from the Settlement Class so that it is received by Settlement Administrator no later than May 26, 2026. You will not receive a cash payment but keep any right you may have to file your own lawsuit against the Defendant about the legal Settlement in this lawsuit.

Attend a Hearing

Ask to speak in Court about why you object to the proposed Settlement. The Final Approval Hearing is scheduled for June 25, 2026 at 12:00 p.m. EST.
